I. GENERAL PROVISIONS
1. This document contains General Terms and Conditions, in accordance with which Epic Media Group Ltd. provides services to the Client through the website epicbychoice.com
By checking the button „I agree with the general conditions“ when ordering products. The Client agrees, fully accepts and undertakes to comply with these General Terms and Conditions.
2. After clicking the „Buy“ button the customer receives confirmation for the order, and it is considered that the contract is excluded.
3. Services offered by Epic Media Group Ltd. through the online store epicbychoice.com are addressed only to adult Clients over 18 years of age.
4. The contractual language is English. All prices and payments subject to these General Terms and Conditions are in Euro and include VAT.
5. Epic Media Group Ltd. reserves the right to change the General Terms and Conditions for greeting the website epicbychoice.com. The general conditions are provided valid from the moment of their publication.
6. Epic Media Group Ltd. is not responsible for non-fulfillment of the obligations described in these General Terms and Conditions in preparation of force majeure, which is not provided and was not required to provide – incl., In case of accidental events, problems in the global network network on the Internet and in offering services beyond the control of Epic Media Group Ltd.
7. For all issues not settled in these General Terms and Conditions, the Bulgarian legislation shall apply.
ІІ. PRICES
1. All prices of items presented on the website epicbychoice.com with Euro and VAT included.
2. The indicated price of a separate product, published in epicbychoice.com is for 1 piece.
3. The prices indicated on the site epicbychoice.com do not include delivery costs.
4. The price of the purchase of products from epicbychoice.com cannot be changed after placing an order, except with the express consent of both parties.
III. CONDITIONS FOR ORDERING AND DELIVERY OF GOODS
1. Terms for ordering, payment and delivery with instructions on the website of epicbychoice.com.
2. Orders are accepted 7 days a week, 24 hours a day through the system.
5. When ordering, the Client indicates a valid e-mail address and correct additional contact details.
6. Indication of incredible / wrong data by the Client on order, makes an order invalid and it is not related to epicbychoice.com with an obligation to perform the delivery. Additional costs for advice at the wrong address are at the expense of the Client.
7. Epic Media Group Ltd reserves the right to make a statement from the delivery of a confirmed order in case the goods are not available. In case of lack of availability of the ordered product, within the working week Epic Media Group Ltd. notifies the Client of the exhaustion by sending a message for providing recommendations from the Client’s e-mail address or telephone number. In case a transfer has been made to the account of Epic Media Group Ltd. , the amounts transferred by the Client will be refunded.
8. Epic Media Group Ltd delivers the goods to the consumer after certification upon fulfillment of the requirements and the existence of circumstances under Art. 61 of the Consumer Protection Act.
IV. WARRANTY PERIODS
Epic Media Group Ltd. offers a warranty document for its customers for a purchased product, only if this document is provided by the product manufacturer.
V. COMPLAINTS AND RETURN OF ORDERED AND DELIVERED GOODS
1. The customer has the right to refuse to receive the requested information from him for the purchase of goods when:
– The delivered goods obviously do not correspond to the requests for purchase from the customer and this can be established through its usual inspection;
2. The right to return received goods under para. 1 shall not apply in the following cases:
– for delivery of goods and provision of services, the price of which depends on the fluctuations of the financial markets, which Epic Media Group Ltd. is not able to control;
– for delivery of goods, made according to the requirements of the consumer or by his individual order;
– for delivery of audio and video recordings or software products printed by the user;
4. After receiving and paying for the goods, the Customer may advertise and seek a refund and refund of payment from another price in the following cases:
– If the goods have a significant defect or non-conformity, which cannot be established during a simple inspection of the goods;
– In the cases of art. 69, para. 3 of the LPPTA.
6. Conditions under which Epic Media Group Ltd. does not recognize a claim for a purchased product:
– In case of indicated incorrect, incomplete or wrong data for address, telephone number or name when submitting the application, it is considered that it is invalid and for Epic Media Group Ltd. there is no obligation for its implementation;
7. For the cases of refusal to receive the goods from the Customer, a protocol is drawn up at the time of delivery. If the Customer refuses to sign the protocol, it is assumed that his refusal to receive the goods is unfounded and he must pay the costs of delivery and return of the goods.
8. Epic Media Group Ltd. is obliged to refund to the Client in full the amounts paid by him not later than 30 days from the date on which the consumer has exercised his right to withdraw from the contract. In case the payment is made with a bank card, the Refund is made by ordering a reverse operation on the card with which the payment was made.
VI. PERSONAL DATA
1. Epic Media Group Ltd. guarantees to its Clients the confidentiality of the provided information and personal data. Subject to applicable law and these General Terms and Conditions, Epic Media Group Ltd. may use the personal data of the Client only for the purposes provided in the contract.
2. Epic Media Group Ltd. does not require from its Clients confidential information, such as bank account numbers, bank card details or personal passwords.
3. The customer is fully responsible for the protection of his username and password, as well as for all actions performed by him or by a third party using the username and password. The user is obliged to immediately notify the team of Supergift.bg of any case of unauthorized access by using his username and password, as well as whenever there is a danger of such use.
4. Epic Media Group Ltd. has the right to send its Clients advertising messages in the form of an electronic newsletter, to the e-mail address specified during registration, in order to acquaint them with possible changes, new goods and promotions.
5. Epic Media Group Ltd. takes measures to protect the personal data of the Client in accordance with the Personal Data Protection Act (https://www.cpdp.bg/?p=element&aid=373).
6. For reasons of security of the personal data of the Users, Epic Media Group Ltd. will send the data only to the address, which was indicated by the Client at the time of registration.
7. At any time, Epic Media Group Ltd. has the right to require the Client to identify himself and certify the authenticity of each of the circumstances and personal data announced during registration.
8. In case for any reason the Client has forgotten or lost his name and password for access to his account, the Client may request the re-sending of the information to the e-mail address with which he is registered on the site of Supergift.bg. If the Client has forgotten his password, it can be recovered from the link for forgotten password in the Login section of the site. To recover and resend a username and / or email address, the change can be made by contacting the Supergift.bg team via email.
9. In case the Client has forgotten or lost his data for access to the e-mail address with which he registered on the site of videofabrika.bg, or this e-mail address no longer exists, the Client may request a change of his main e-mail. to access your account by writing an email to the team of Epic Media Group Ltd. In order to finalize this change, Epic Media Group Ltd. will require from the Client a copy, certified with “True to the original”, of an identity document issued by the state authorities (passport, ID card or driving license).
10. Epic Media Group Ltd. accepts and announces on its website the above-stated personal data protection policy, as an integral part of the General Terms and Conditions, available at videofabrika.bg.
VII. CONTENTS
2. It is forbidden to copy texts from the pages of epicbychoice.com and publish them on other sites without the written consent of Epic Media Group Ltd.
3. It is allowed to quote texts from the pages of epicbychoice.com by placing the following text: „Source: epicbychoice.com“, as well as a link to: epicbychoice.com.
4. Epic Media Group Ltd is not liable to the Clients and third parties for damages and lost profits caused by the termination, suspension, change or restriction of services, deletion, modification, loss, inaccuracy, inaccuracy or incompleteness of messages, materials or information. , transferred, used, recorded or made available through videofabrika.bg.
5. Epic Media Group Ltd. reserves the right to change the prices for the available items without notifying the Client in advance.
VIII. AMENDMENT AND ACCESS TO THE GENERAL TERMS
1. These general terms and conditions may be amended by Epic Media Group Ltd. at any time, for which the latter will duly notify all its registered customers.
2. Epic Media Group Ltd. and the Client agree that any addition and amendment of these general terms and conditions will have effect on the Client after his explicit notification by Epic Media Group Ltd. The client is given a 14-day period in which he can reject in writing the General Terms and Conditions of Epic Media Group Ltd. Only Customers who have registered and provided email addresses will be notified of changes. The other Clients who shop online as a Guest are responsible for familiarizing themselves with the current General Terms and Conditions, published on all sites owned by Epic Media Group Ltd.
3. The Client agrees that all statements of Epic Media Group Ltd. in connection with the amendment of these general terms and conditions will be sent to the e-mail address specified by the Client during registration. The Client agrees that e-mails sent in accordance with this Article do not need to be signed with an electronic signature in order to have effect on him.
4. Epic Media Group Ltd. publishes these general terms and conditions at epicbychoice.com, together with all additions and amendments thereto.
IX. TERMINATION
1. The present general conditions and the contract of the Client with Epic Media Group Ltd. are terminated in the following cases:
– upon termination and declaration of liquidation or declaration of bankruptcy of one of the parties to the contract;
– by mutual consent of the parties in writing; unilaterally, with notice from each of the parties in case of non-fulfillment of the obligations of the other party;
– in case of objective impossibility of any of the parties to the contract to perform its obligations;
– in case of seizure or sealing of the equipment by state authorities;
– in case of deletion of the Client’s registration on the site videofabrika.bg. In this case, the concluded but not executed contracts of sale remain in force and are subject to execution;
– in case of exercising the right of withdrawal according to art. 55, para. 1 of the Consumer Protection Act.
These general terms and conditions enter into force for all Users on November 15, 2018.
